In a landmark ruling, the UK Supreme Court has confirmed that the legal definition of “woman” under the Equality Act 2010 refers to biological sex. This unanimous decision was a major victory for women’s rights campaigners and a crucial step in protecting single-sex spaces in law.

The case was brought by For Women Scotland in response to Scottish government guidance that allowed males with Gender Recognition Certificates to be treated as women in law. The Court ruled this interpretation unlawful, stating that “sex is binary” and that a GRC does not change a person’s legal sex under the Equality Act.
This judgment upholds the rights of women to access female-only services such as shelters, hospital wards, changing rooms, and sports categories—based on biological sex. It also protects the freedom of same-sex attracted individuals to form their own communities without confusion over legal definitions.
The Equality and Human Rights Commission welcomed the decision, calling it a resolution to long-standing legal ambiguity.
